Residence Permit & VisaResidence Permit: when purchasing real estate

Residence Permits and Visas Regulation (İKAMET İZİNLERİ ve VİZELER TÜZÜĞÜ), Article 14 states:

(2) (b) In an application for a residence permit submitted by a foreigner who owns immovable property;

(i) The residence must be habitable and used for that purpose. (In other words, the construction of real estate must be completed)

(ii) If a certificate of ownership (title deed) for the same place of residence is divided into more than one share, and any shareholder has received a short-term residence permit in accordance with this paragraph, a short-term residence permit cannot be granted to another shareholder for the same place of residence. However, if one of the shareholders in the same place of residence has received a short-term residence permit, but on its basis a family residence permit has not been obtained, the second shareholder may also be granted a short-term residence permit. In cases where more than one short-term residence permit is issued for the same place of residence in this way, a family residence permit cannot be issued on the basis of any of these permits.

(iii) In the event that the immovable property has been acquired under a contract, at least one third of the sale price must be paid and an application must be made for permission to acquire the immovable property from the Council of Ministers.

(iv) If the property has a title deed in the applicant’s name, the applicant must earn at least one minimum wage per month; in the event that real estate is paid for under a current contract, the applicant must have an income of at least one minimum wage per month in addition to the amount of the monthly payment in the contract.

(v) Notwithstanding otherwise provided in this Statute, this type of residence permit is issued for a period of one year on first application and thereafter for a maximum of three years, provided that he/she has received a certificate of ownership ( title) in your name.

Based on the above, please note that one of the prerequisites is the submission of an application in order to obtain permission to purchase from the Council of Ministers. In order to apply, in addition to general information, the contract of sale, title deed, map of the site and the passport of the purchaser, criminal report from the authorities of the purchaser’s home country is also required. This application is submitted only to the person specified in the sales contract and is not issued to the spouse.
